TERMS AND CONDITIONS OF USE

Clause 1 - Scope


The General Terms and Conditions of Sale detailed below (hereafter the "General Terms and Conditions"), governing contractual relations between all laguiole-attitude.com site users (hereafter "User" or "You") and the company SAS Inox Cookware France with a share capital of €10000 and its registered office at 17 rue mensal 75116 Paris, France, registered in the Paris trade and company register under number 753 943 745 and with VAT number FR 88 753 943 745 (hereafter "SAS Inox Cookware France"). These General Terms and Conditions of Sale are the only ones applicable and replace any other terms and conditions, unless expressly indicated otherwise beforehand in writing. From time to time, Bee Design may be required to amend certain provisions within its General Terms and Conditions. They must therefore be reread before each visit to the laguiole-attitude.com site (hereafter the "Site"). We consider that by validating your order, you agree without any reservations to our General Terms and Conditions of Sale after having read them. By accessing the Site, you undertake to comply with the General Terms and Conditions, as well as the Conditions for Use indicated therein.



Clause 2 - Contract - Conditions for placing an order


You declare that you are at least 18 years old and have legal capacity or parental authorization allowing you to place an order on the Site.



Clause 3 - Contract - Steps for concluding the contract


After placing your order, we will send you an email confirming the items in your order. This email constitutes our acceptance of your order and therefore represents the contract of sale between You and Us.



Clause 4 - Pricing


The sales prices indicated on the Site are in euros, but excluding delivery costs.

VAT on products purchased in FRANCE or the EUROPEAN COMMUNITY AREA: The products include French VAT at 19.6%.

VAT on products purchased OUTSIDE OF THE EUROPEAN COMMUNITY AREA: The Company is not under any circumstances involved in VAT for countries outside of the European Community, since products are sold EXCLUDING VAT, in other words it does not declare any VAT on these countries. Each customer of the www.neoflamfrance.com Site is therefore responsible for declaring the VAT or not in accordance with the legislation in force in the country where the purchase transaction takes place. As such, we reject any liability.

Any delivery costs are to be covered by the User and are billed at the end of the order in addition to the products selected. We reserve the right to change our prices at any time, but we undertake to apply the prices in force and indicated to you on the Site at the time of your order.



Clause 5 - Availability


Orders will be honored within the limits of available stock. If any of the products ordered are not available in stock, we undertake to contact you by email or phone within 30 days of the date of your order in order to inform you about this and indicate the timeframe within which this product could be delivered to you, if applicable.



Clause 6 - Product information


In accordance with Article L111-1 of the French consumer code (Code de la Consommation), the User may, prior to their order, obtain information on the essential characteristics of one or more products they wish to order on the Site, by clicking on the product. The photographs illustrating the products and the graphics are purely for information, are not contractually binding and do not in any way constitute a commitment by SAS Inox Cookware France.

Clause 7 - Payment


You may pay for your order using a bankcard (debit or credit card) or the PayPal system.

For bankcard payments, the transaction will be carried out securely using Cyber Plus, Banque Populaire's secure online payment service. All the data entered by the User when paying by bankcard is immediately encrypted thanks to the SSL protocol and recorded on the Banque Populaire server. The information is entered directly liaising with the bank's payment server. For security reasons, no payment data concerning the User is stored on the www.laguiole-attitude.com site. The amount is debited on the day of your order provided that the authorization to debit your account has been obtained beforehand from the competent payment centers, without which your order cannot be taken into consideration.

In the event of reimbursements, the User is reimbursed by crediting their bank account for payments by bankcard, or otherwise using PayPal.

Clause 8 - Warrantees and after sales service


Certain items are covered by a warranty, with the relevant terms and conditions supplied with the product. Whatever the problem concerning your item, you must enclose a copy of the bill and its warranty form with the defective item.
The warranty does not apply for repairs to damage resulting from any improper use of the product.
The warranty does not cover transport costs.



Clause 9 - Burden of proof


The Customer acknowledges that IT recordings, statements and IT listings and other electronic media may be admissible as proof, notably in connection with any dispute that may arise from any breach of the present clauses by any of the Parties.



Clause 10 - Delivery


SAS Inox Cookware France will deliver your order to the address of your choice in France. The products are generally available in stock. Otherwise, Bee Design may make a partial delivery. The remaining items will be either delivered at a later date, or replaced by another item of your choice, or reimbursed.

In France and Corsica:

Deliveries are carried out from Monday to Saturday by La Poste using COLISSIMO SUIVI, which provides you with several value-added services:



- Delivery within 48 hours of your order being processed.


- Delivery within 7 days for crockery.



You will be asked to make a flat-rate contribution to the costs for processing your order by COLISSIMO. This contribution will depend on the weight and volume of your order. You will be able to see the delivery costs for your order in your basket before making the payment for your order.

Delivery costs are free for orders over €130, except crockery plates, bowls, cups and mugs or a weight not exceeding in 3 kg.

You can track your parcel by connecting up to the www.coliposte.net site.

In all cases, products ordered are transported at the Web User's own risk. Indeed, Web Users must check the condition of the goods when the package arrives and have 48 hours to report any issues to the transporter if any items are missing or damaged. The customer must then immediately notify neoflamfrance.com by sending an email to the following address: contact@neoflamfrance.com.

Any complaints must be submitted to the email address indicated above.

The delivery times indicated on the Site are purely for information and may be amended.

If you do not receive your package within the timeframes indicated, an inquiry is carried out with the transporter and this may take several days (e.g. 21 days for La Poste). During this period, items may not be reimbursed or sent out again.

On receipt of your order, you must check that the products delivered effectively correspond to your order and, if necessary, write any anomalies concerning them on the delivery form, accompanied by your signature. You will also need to confirm these reservations the same day or at the latest one working day after receipt of your order by sending a letter to SAS Inox Cookware France, Customer Service, 17 rue mensil 75116 Paris, France or an email to contact@neoflamfrance.com. Any claims made outside of this timeframe will not be able to be accepted and will free SAS Inox Cookware France from any liability in relation to the User. If the products need to be returned to us, this must be done within two working days of delivery to the following address: SAS Inox Cookware France, Customer Service, 17 rue mensil 75116 Paris, France. Returns may only be accepted for products in their original condition, i.e. notably with their packaging, accessories and operating instructions. Postal costs are to be covered by the User.

neoflamfrance.com may not be held liable in the event of any postal delays.



Clause 11 - Liability


SAS Inox Cookware France may not be held liable for the contract not being fulfilled in the event of a case of force majeure, total or partial strike or disruption, notably concerning postal services and means of transport or communication, flooding, fire or war. SAS Inox Cookware France may not be held liable in any way for any indirect damages, loss of operations, loss of profit, loss of opportunities, damages or costs which may arise as a result of purchasing any product presented on the Site.
We would like to remind you that it is prudent to back up any data contained in the product purchased. SAS Inox Cookware France may not be held liable for any loss of data, files or more generally any damages which may result from the User failing to back up any data contained in the products purchased.
SAS Inox Cookware France may not be held liable for any consequences resulting from the improper use of any products sold on the Site.
In the event of it being impossible to use the products at all, notably as result of material incompatibilities, this may not result in any compensation or reimbursement or any liability claims against SAS Inox Cookware France.
Hypertext links may refer to sites other than the Site. Laguiole-attitude.com does not accept any liability in the event of the contents of such sites breaching any legal or regulatory provisions in force.
In any case, SAS Inox Cookware France's liability would be limited to the amount of the order.



Clause 12 - Right to retract -Satisfied or money back


As provided for under Article L 121-20 of the French consumer code, you have seven working days to return a product to us if you are not satisfied. Within this timeframe, you may return this product, at your own cost, accompanied by your bill. We will only be able to accept complete products whose condition is as new (accessories, operating instructions, etc.), returned in their original packaging to the following address:

. Any products which have been damaged, or for which the original packaging has been damaged, will not be reimbursed or exchanged.
If the item returned to SAS Inox Cookware France is incomplete or damaged, a discount will be applied to its price based on the analysis carried out by the after sales team. Products that have been personalised with an engraving can only be exchanged if they have a defect
The timeframes referred to above run from the order delivery date.
This right to retract may be exercised without any penalties, with the exception of the costs for returning items. If they exercise their right to retract, the User may choose to either be reimbursed for the sums paid, or get the product exchanged. In the event of an exchange, the User will cover the costs for shipping the products to be received in exchange to them.
If the right to retract is exercised, Bee Design will do its utmost to reimburse the User as quickly as possible. The User will then be reimbursed by crediting their bank account for payments by bankcard, or otherwise using PayPal.



Clause 13 - Privacy


Since the information you provide to us is essential for processing and shipping orders, as well as drawing up bills and warranty agreements, your order will be cancelled if it is not provided. By registering on the Site, you undertake to provide us with true and accurate information concerning you. Providing inaccurate information constitutes a breach of the present General Terms and Conditions, as well as the conditions for use presented on the Site. In accordance with the French data protection act, the processing of your information has been registered with the French data protection agency (CNIL).
SAS Inox Cookware France is authorized to extract, process and use the information concerning you. Such data is subject to IT processing.
You have the right to access and rectify any data concerning you, in accordance with the European regulations and French laws in force (Article 34 of the French law of January 6, 1978). At any time, you may submit a request to SAS Inox Cookware France in order to establish what information it has concerning you. You may amend such data at any time and on request.
You may ask to no longer receive emails from us at any time by clicking on this address (contact@neoflamfrance.com) or on the dedicated link included at the bottom of each email we or any of our partners send to you.
Only SAS Inox Cookware France holds information concerning you. Only SAS Inox Cookware France and its contractual partners may send you information in connection with specific and one-off promotional operations. These partners are specially selected by Bee Design and are recognized for the quality of their products and services.



Clause 14 - Disputes


The present contract is subject to French law. Any dispute, whatever the delivery location, which may result in the interpretation or execution of the present General Terms and Conditions will be subject to the competent jurisdictions of the defendant's trade court.
